1. Acceptance of Terms

By downloading, installing, accessing, or using Johnnie’s Old Time Radio (the “App”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the App.

2. Description of Service

Johnnie’s Old Time Radio provides streaming access to classic old-time radio programs from the golden age of radio broadcasting. All audio recordings featured in this App are in the public domain.

The App offers:

• Free access to public domain radio programs
• Premium subscription for enhanced features and exclusive access to additional public domain content
• Audio playback with download capabilities
• Integration with CarPlay and other system features
• Curated collections and organization of public domain content

3. User Accounts and Registration

The App does not currently require user account creation. Subscription status is managed through your Apple ID and the App Store.

4. Premium Subscriptions

4.1 Subscription Options

The App offers premium subscriptions that provide enhanced features and access to additional curated public domain content. Available subscription plans include:

4.2 What Premium Subscriptions Include

Premium subscriptions provide:

• Access to our full curated collection of public domain recordings

Important Note: Premium subscriptions grant you access to enhanced app features and our full curated collection. All audio recordings remain in the public domain regardless of subscription status, and public domain recordings can be freely obtained from other sources.

4.3 Pricing and Payment

• Subscription prices are displayed in the App and may vary by region
• Payment is charged to your Apple ID account at confirmation of purchase
• All payments are processed through Apple’s App Store
• Prices are subject to change with notice

4.4 Auto-Renewal

• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage your subscription and turn off auto-renewal in your App Store account settings

4.5 Cancellation and Refunds

• You may cancel your subscription at any time through your App Store account settings
• Cancellation takes effect at the end of the current billing period
• Refunds are handled by Apple according to their refund policies
• Upon cancellation, you will retain access to premium features until the end of your current billing period

5. Content and Intellectual Property

5.1 Public Domain Audio Recordings

All audio recordings of classic old-time radio programs provided through the App are in the public domain. These recordings are not owned by Johnnie’s Old Time Radio, and we make no claim of copyright or ownership over the audio content itself.

You are free to:

• Access, listen to, and enjoy these public domain recordings
• Download these recordings for personal or commercial use
• Share, distribute, or redistribute the audio recordings
• Create derivative works from the recordings
• Use the recordings for any lawful purpose

These public domain recordings are available from various sources, and your access to them is not dependent on this App.

5.2 App Software and Presentation

While the audio recordings themselves are in the public domain, the following elements are proprietary to Johnnie’s Old Time Radio and protected by copyright and other intellectual property laws:

• Interfere with or disrupt the App’s functionality or servers

Clarification: These restrictions apply only to the App software itself, not to the public domain audio recordings which you may freely use, share, and distribute.

6. Content Availability

6.1 Content Changes

We reserve the right to:

• Add or remove content from the App at any time without notice
• Temporarily or permanently discontinue any features
• Modify how content is organized or presented
• Vary content availability by subscription tier

6.2 No Guarantee of Availability

While we strive to maintain a comprehensive collection of public domain radio programs, we do not guarantee:

• That any specific recording will always be available in the App
• The completeness of our collection
• That the App will be your only or best source for any particular recording

Public domain recordings are available from many sources, and we encourage users to explore multiple avenues for accessing this historical content.

6.3 Public Domain Status

We make a good faith effort to ensure that all audio recordings in the App are in the public domain in the United States. However:

• Public domain status may vary by jurisdiction
• We do not provide legal advice regarding the public domain status of any recording
• Users are responsible for determining applicable rights in their jurisdiction

7. User Conduct

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Infringe upon the rights of others
• Transmit any harmful code, viruses, or malware
• Attempt to gain unauthorized access to any portion of the App infrastructure or related systems
• Interfere with or disrupt the App’s servers or services
• Use the App in any manner that could damage, disable, or impair the App’s functionality
• Engage in any activity that constitutes abuse of the service
• Misrepresent your identity or affiliation
• Use the App for any fraudulent or unauthorized purpose

8. Downloads and Offline Access

8.1 Download Feature

Users with premium subscriptions may download public domain recordings through the App for offline listening:

• Downloads are stored locally on your device
• Downloaded files remain accessible on your device even after subscription cancellation
• The App may use technical measures to manage downloads within the App interface
• You may also obtain these same public domain recordings from other sources

8.2 Storage Limitations

You are responsible for managing storage space on your device. We are not liable for any issues related to insufficient device storage.

8.3 Downloaded Content

Because all recordings are in the public domain:

• You retain full rights to use downloaded recordings even after canceling your subscription
• Downloaded recordings may be shared, used, or distributed according to public domain rights
• The App’s download feature is provided as a convenience, not as a licensing mechanism

9. CarPlay and System Integration

The App may integrate with iOS system features such as CarPlay. You are responsible for using these features safely and in compliance with applicable laws, including traffic and vehicle operation laws.

Safety Warning: Never use your device in a way that distracts you from driving safely. Always obey traffic laws and focus on the road.

10. Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to our collection and use of information as described in the Privacy Policy.

We respect your privacy and do not track what specific public domain content you access, download, or listen to.

11. Third-Party Services

The App may contain links to or integrate with third-party services. We are not responsible for the content, terms, or privacy practices of any third-party services.

12. Disclaimers

12.1 Service Availability

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that:

• The App will be uninterrupted, secure, or error-free
• Content will always be available
• Defects will be corrected
• The App will be compatible with all devices or operating system versions
• Any particular public domain recording will be available at any given time

12.2 Content Accuracy and Quality

While we strive to provide accurate information about shows, episodes, and metadata:

• We do not warrant the accuracy or completeness of any content descriptions or information

• Metadata and episode information is provided on a best-effort basis

• Public domain status may differ in other countries
• Users are responsible for complying with applicable laws in their jurisdiction

12.4 Historical Content

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM
• WE ARE NOT LIABLE FOR ANY LOSS OF DATA, PROFITS, BUSINESS, OR OPPORTUNITY
• WE ARE NOT LIABLE FOR ANY CLAIMS RELATED TO YOUR USE OF PUBLIC DOMAIN CONTENT OBTAINED THROUGH THE APP

This limitation applies to claims based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless Johnnie’s Old Time Radio, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to:

• Your use of the App software
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations
• Any claims arising from your use of public domain content accessed through the App

15. Termination

15.1 Termination by You

You may stop using the App at any time by:

• Deleting the App from your device
• Cancelling any active subscriptions through your App Store account settings

Any public domain recordings you have downloaded remain yours to keep and use according to public domain rights.

15.2 Termination by Us

We reserve the right to:

• Suspend or terminate your access to the App at any time for any reason, including violation of these Terms
• Modify or discontinue the App or any features at any time
• Refuse service to anyone for any reason at any time

15.3 Effect of Termination

Upon termination:

• Your right to use the App software will immediately cease
• You should delete the App from all devices
• Your access to premium features will end
• You retain all rights to any public domain recordings you have downloaded
• Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability

16. Geographic Restrictions

The App is controlled and operated within the United States. We make no representation that the App or content is appropriate or available for use outside the United States.

Public domain status is determined under United States law. If you access the App from outside the United States:

• You do so at your own risk
• You are responsible for compliance with local laws
• Copyright status may differ in your jurisdiction
• You are responsible for determining the legal status of recordings in your country

17. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted in the App. Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.

We will make reasonable efforts to notify you of material changes, such as:

• In-app notifications
• Update to the “Last Updated” date at the top of these Terms
• Email notification (if you have provided contact information)

If you do not agree to the modified Terms, you must stop using the App software.

18. Apple App Store Requirements

These additional terms apply to your use of the App obtained through the Apple App Store:

18.1 Acknowledgement

• These Terms are between you and Johnnie’s Old Time Radio only, not with Apple Inc. (“Apple”)
• Johnnie’s Old Time Radio, not Apple, is solely responsible for the App and its content

18.2 Scope of License

• The license granted to you for the App software is limited to a non-transferable license to use the App on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions
• You may not distribute or make the App software available over a network where it could be used by multiple devices at the same time

18.3 Maintenance and Support

• Johnnie’s Old Time Radio is solely responsible for providing any maintenance and support services with respect to the App, as specified in these Terms or as required under applicable law
• Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App

18.4 Warranty

• Johnnie’s Old Time Radio is solely responsible for any product warranties regarding the App software, whether express or implied by law, to the extent not effectively disclaimed
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App (if any) to you
• To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App
• Any other claims, losses, liabilities, damages, costs or expenses attributable to any failure of the App software to conform to any warranty will be the sole responsibility of Johnnie’s Old Time Radio

18.5 Product Claims

Johnnie’s Old Time Radio, not Apple, is responsible for addressing any claims you have or any claims of any third party relating to the App or your possession and use of the App, including:

• Product liability claims related to the App software
• Any claim that the App fails to conform to any applicable legal or regulatory requirement
• Claims arising under consumer protection or similar legislation

18.6 Intellectual Property Rights

In the event of any third-party claim that the App software or your possession and use of the App infringes that third party’s intellectual property rights, Johnnie’s Old Time Radio, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

Note: This does not apply to the public domain audio recordings, which are not subject to copyright claims.

18.7 Legal Compliance

You represent and warrant that:

• You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country
• You are not listed on any U.S. Government list of prohibited or restricted parties

18.8 Third-Party Beneficiary

Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms as they relate to your license of the App, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

19. StoreKit and In-App Purchases

19.1 Payment Processing

• All subscription purchases are processed by Apple through their StoreKit framework
• Payment will be charged to your Apple ID account at the confirmation of purchase
• All transactions are subject to Apple’s Terms of Service and the Licensed Application End User License Agreement

19.2 What You’re Paying For

When you purchase a premium subscription, you are paying for:

• Access to the App’s premium features
• Access to our full curated collection of public domain content
• Enhanced functionality and user experience
• Offline download capabilities through the App
• Ad-free experience (if applicable)
• Support for ongoing App development and maintenance

You are not paying for the audio recordings themselves, which are freely available in the public domain.

19.3 Family Sharing

• If enabled by Apple, subscriptions purchased through the App may be shareable with your Family Sharing group in accordance with Apple’s Family Sharing terms
• Check the App Store listing for Family Sharing availability

19.4 Subscription Information

• Subscription details, including pricing and renewal dates, are available in your App Store account settings
• You can view, change, or cancel your subscription at any time by going to your Account Settings on the App Store

20. Governing Law and Dispute Resolution

20.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the applicable state law where Johnnie’s Old Time Radio operates, without regard to conflict of law principles.

20.2 Informal Dispute Resolution

We encourage you to contact us first at Support@RuffinApps.com to resolve any issues informally before pursuing formal dispute resolution. We are committed to working with you to address any concerns.

20.3 Arbitration Agreement

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

The arbitration will be conducted by the American Arbitration Association (AAA) under its rules, including the AAA’s Consumer Arbitration Rules. The AAA’s rules are available at www.adr.org or by calling 1-800-778-7879.

Payment of all filing, administration, and arbitrator fees will be governed by the AAA’s rules. If your claim is for $10,000 or less, we agree that you may choose whether the arbitration will be conducted solely on the basis of documents submitted to the arbitrator, through a telephonic hearing, or by an in-person hearing.

20.4 Class Action Waiver

YOU AND JOHNNIE’S OLD TIME RADIO AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Unless both you and Johnnie’s Old Time Radio agree, no arbitrator or judge may consolidate more than one person’s claims or otherwise preside over any form of a representative or class proceeding.

20.5 Exceptions to Arbitration

The arbitration requirement does not apply to:

• Claims for injunctive or equitable relief regarding intellectual property rights in the App software
• Small claims court actions that remain in small claims court
• Claims that may be brought in any court with jurisdiction if all parties agree in writing

20.6 Opt-Out Right

You have the right to opt out of this arbitration agreement by sending written notice of your decision to opt out to Support@RuffinApps.com within 30 days of first accepting these Terms. Your notice must include your name and address, and a clear statement that you want to opt out of this arbitration agreement.

21. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent authority, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

22. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published by us in the App, constitute the entire agreement between you and Johnnie’s Old Time Radio regarding the App software and supersede all prior or contemporaneous agreements, understandings, and communications, whether written or oral.

23. No Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

24. Assignment

You may not assign or transfer these Terms or your rights under these Terms, in whole or in part, by operation of law or otherwise, without our prior written consent. We may assign these Terms at any time to any affiliate or in connection with a merger, acquisition, reorganization, or sale of all or substantially all of our assets, or by operation of law, without your consent.

25. Language

These Terms are written in English. To the extent any translated version of these Terms conflicts with the English version, the English version controls.

26. Force Majeure

We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

27. California Residents

If you are a California resident, you may have these Terms mailed to you electronically by sending a letter to Support@RuffinApps.com with your electronic mail address and a request for these Terms.

In accordance with California Civil Code Section 1789.3, you may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by contacting them in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

5. YOU ARE AT LEAST 13 YEARS OF AGE (OR THE MINIMUM AGE REQUIRED IN YOUR JURISDICTION)
6. IF YOU ARE UNDER 18, YOUR PARENT OR GUARDIAN HAS REVIEWED AND AGREED TO THESE TERMS
